Contract signing and ratification: areas of opportunity for Incremex

All of Incremex's documents were signed by hand, most notably two types: pure or financial automotive lease agreements and their corresponding promissory notes.

Once a client's lease line was approved, the lessor's legal representative would sign the contracts. However, collecting the signatures of the lessee and their guarantor could take weeks, as Incremex had to send a courier to each person's location.

To make matters worse, all documentation had to be ratified before a notary or public broker. This added an extra step and required coordinating a date and time when all parties were available, in addition to representing an unavoidable cost.

Mifiel and the legal presumptions of electronic signatures: streamlining leasing processes at Incremex

Incremex clients can now sign electronically, eliminating travel expenses for the agent and having signatures ready in a matter of hours.

Furthermore, one of the main reasons for ratifying signatures before a notary was to enjoy the presumption of attribution for signatures and a guarantee of document integrity. Since Mifiel works with electronic signature certificates and includes preservation records, both legal presumptions are obtained. This makes it no longer essential to hire the services of a public notary.

Document handling in the event of an incident

When a leased vehicle is involved in an incident (such as a crash), the lessee usually needs to prove that the vehicle is under lease and that they are the legitimate user. The lessor then acts on their behalf before the relevant authorities.

Unlike judges who are accustomed to working with electronic signature models, traffic police and insurance adjusters are generally not trained to receive electronically signed documentation.

Incidents are special situations that do not typically affect the majority of their users. For this reason, Incremex implemented a process that involves sending an agent with documents autographed by the lessor's legal representative. The agent then collects the lessee's signature and finally goes to the corresponding authority, such as the vehicle impound lot or insurance offices.

In this way, both Incremex and its lessees benefit from digital signatures, only activating the special process in the event of an incident. Their costs are lower than handling the entire process traditionally from start to finish.
