Discover the different types of signatures that exist in Mexico and how they are used at Mifiel

An advanced electronic signature is generated using a cryptographic tool, such as the SAT's e.firma, which consists of a public certificate and a private key.
The generation of the e.firma follows a rigorous identity and biometric data verification process, as stipulated by Article 97 of the Commercial Code, to provide greater legal robustness.

Any electronic signature that meets the requirements of Article 89 of the Commercial Code is considered a simple electronic signature.
It requires an exchange of secret keys and passwords during the document signing process.
At Mifiel, we take a photo of the signer and their valid official ID to link them to the signed document, thereby strengthening the presumption of attribution.

This advantage is conferred exclusively to the FEA.
The non-repudiation guarantee makes it legally and technically impossible to deny the signature.

The presumption of attribution shifts the burden of proof to the signer in the event they deny having signed. This presumption is granted to any electronic signature, provided it meets legal requirements.

Although more and more people have an e.firma, it is not yet universal. A simple signature allows anyone with access to a computer or mobile phone and a valid official ID to sign electronically.

Contrary to popular belief, signing with an e.firma is not complex. In comparison, a simple signature often requires a more extensive process for signers, as it is recommended to collect supporting evidence (such as photos or videos of the signers and identity documents).

With Mifiel, you have the flexibility to offer your signers the option to sign with either an advanced electronic signature or a simple signature without compromising legal robustness.
Given its non-repudiation guarantee, we recommend using the e.firma for documents that could potentially be taken to court.
But don't worry, if you choose Mifiel's simple signature, you will still be protected in litigation. We capture a photograph of the signer and their official ID, which serves as proof of life in the event of a trial.
